Adoption Rights Alliance Definition of Illegal Adoptions

1.  Where a non marital child has been deliberately registered as the natural child of the adoptive parents without the natural mother’s knowledge or consent and NO ADOPTION ORDER was made so there is no corresponding file at the Adoption Board but a file usually exists at an adoption agency.  In effect, the details of the child’s birth and parentage have been deliberately withheld and a false birth registration has been made in the names of the adoptive parents and in some cases the actual DOB is changed to reduce the risk of discovery. We are investigating instances of this. 

2.  Where a non marital child has been deliberately registered as the natural child of the adoptive parents but AN ADOPTION ORDER DOES EXIST so there is a corresponding file at the Adoption Board and in most cases, a file will also exist at an adoption agency.  There is a question mark over whether or not the natural mother was aware of the illegal nature of her child’s birth registration and papers within the Adoption Board files would need to scrutinised for evidence of her collusion. In effect, the details of the child’s birth and parentage have been deliberately withheld and a false birth registration has been made in the names of the adoptive parents. We are investigating instances of this. 

3.  Where a marital child has been deliberately registered as the natural child of the adoptive parents and NO ADOPTION ORDER was made so there is no corresponding file at the Adoption Board but a file usually exists at an adoption agency. We suspect that in such cases, the natural mother would have been aware of the illegal nature of her child’s birth registration and adoption and would have actively colluded with the subterfuge.  In effect, the details of the child’s birth and parentage have been deliberately disguised and a false birth registration has been made in the names of the adoptive parents and in some cases an alias or the mother’s maiden name is used at the maternity hospital/nursing home. We are investigating instances of this. 

4.  Where a marital child has been deliberately registered as the natural child of the adoptive parents but AN ADOPTION ORDER DOES EXIST so there is a corresponding file at the Adoption Board and in most cases, a file will also exist at an adoption agency.  We suspect that in such cases, the natural mother would have been aware of the illegal nature of her child’s birth registration and adoption and would have actively colluded with the subterfuge. In effect, the details of the child’s birth and parentage have been deliberately disguised and a false birth registration has been made in the names of the adoptive parents. We are investigating instances of this. 

5.  Where the adoptive parents were not resident in the state at the time of the adoption - i.e. in all cases of the 2000+ babies sent to the US, in particular the babies sent to the US by the registered adoption agency St Patrick’s Guild. 

6.  Where a relinquished child over 1 year’s of age was sent overseas for adoption without the consent and knowledge of the natural mother - i.e. in the cases of the 2000+ babies sent to the US, in particular the babies sent to the US by the registered adoption agency St Patrick’s Guild. 

7.  Where informed consent was not given, as in the case of natural mothers who were minors who signed consents without a guardian or legal advisor present, without understanding the import of severing parental rights and who were promised on-going contact through so-called “open-adoption” arrangements as in the case of the former RGAS. We are investigating such cases. 

8.  Any adoption arranged by a private person or private body, not regarded as a “registered Adoption Agency”, could be considered as illegal particularly if it can be demonstrated that the individual or body did not provide written statements setting out clearly (in the prescribed form) the effect of an adoption order upon the rights of a mother or guardian. Failure to have done so would surely nullify any signed document proporting to be an informed consent. We are investigating such cases. 

9.  Any adoption arranged by a registered adoption agency or other body for the purpose of financial gain could be regarded as illegal as it calls into question whether or proper consents were sought or obtained. We are investigating such cases.
